Injured At An Amusement Park? | Law Offices of Brian J. Mongelluzzo

No one plans a fun summer trip to an amusement park expecting to be injured. Every year roughly 9,000 people are injured at amusement parks and carnivals according to estimates by the US Consumer Product Safety Commission (CPSC).

A Springfield, Massachusetts woman is currently suing Six Flags Great Escape in New York claiming that in 2019 she broke her ankle after slipping on a grassy knoll covered in goose feces. Asserting that she is unable to work due to the injury, she is currently seeking a $250,000 settlement in a recently filed lawsuit.

Lack of adequate restrictions, under-trained workers, understaffed games and rides, and poorly maintained equipment all play roles in scary and scarring amusement-park injuries. Typically, many ride-related injuries a minor, however, there are an average of 4.5 deaths per year.

Earlier this summer an 11-year-old Iowa boy died, and three others were injured when a ‘Raging River’ water ride malfunctioned at Adventureland Park. According to witnesses, the family’s boat flipped over within 20 seconds of the ride beginning causing all six people aboard to hit their heads on the surface below and trapping them in their seatbelts underneath the water.

No one should be forced to endure unnecessary physical and emotional trauma, or even die, because of another party’s recklessness. Most accidents result in lawsuits with an amusement park and ride owners eventually providing substantial compensation to victims.

An action in negligence may be brought against all individuals and entities involved for injuries resulting from that negligence. For example, parks may opt-out of scheduled maintenance or full-staff training, to save time and money. Actions such as these compromise visitors’ safety and may lead to legal liability on the part of those who make such decisions.
